The 2005 Kenthill Townhomes Homeowners Board has been a Board since April. The Attorney for the Association wrote a letter to all Kenthill homeowners in March. In the letter, he said that the Association had to vote to approve any House Rules we may have. There is no record of Kenthill Homeowners ever having done this. The Attorney also said that the late fee needed to be changed from $20 to $10, to match what is said in our Declarations. Therefore, the 2005 Board changed the late fee in the House Rules from $20 to $10. Before announcing a Special Meeting to have the Association vote on the House Rules, the 2005 Board submitted a copy to the new property management company, to see if there were any other problems with our House Rules. One item was corrected in the first section of the House Rules by cutting it out and replacing it with a long paragraph they suggested (easier than trying to "fix" it). Then the 2005 Board submitted the House Rules to the Attorney for the Association to see if there were any other corrections that needed to be made. He found several additional sections that conflicted with our Declarations (such as Building reps, etc.) These sections were deleted.
The 2005 Board did not write nor re-write the Kenthill Townhomes House Rules. They did not write nor re-write the House Rules, in the sense that all they did was take the current House Rules and correct them, as per the instructions given to them by our property management company (who we pay to guide us in such matters) and the Attorney for the Association who guides us in these matters in accordance with Washington State law.
The 2005 Board is asking that the Kenthill Townhomes homeowners approve the current House Rules as they now stand. It was asked at the June 27, 2005 meeting, "Where do we go from here?" The reply given was that all interested homeowners should submit their ideas, suggestions, and comments regarding the House Rules [send them to nancyl@suhrco.com]. At a later date, the 2005 Board can review the comments, making changes that would be good for all 82 homeowners and that would be legal, etc. It was said that our Declarations were written in the 1970's, and may need to be changed in order to be able to have the House Rules that we want, and in order to comply with the Washington State Condominium Act which the Legislature passed in 1990. It may be only then, after making changes to our Declarations, that we can finally have the Kenthill Townhomes House Rules say exactly what we want them to say.
But until that time, we cannot continue without House Rules. The parking problems continue to be an issue, with some homeowners and renters attempting to have as many as 4 vehicles for one Unit. Homeowners are letting their dogs and cats roam freely on the property the feces problem has is now so bad that the landscapers, having told us repeatedly about this issue for 6 months now, have now informed us that they are unable to do their jobs in certain areas of the property. The police have been called out to the property more times in three months than ever before in recent memory, to help in addressing an increasing problem regarding noise and behavior calls to 911.
It is now the Summer months, and it is difficult to work around vacations and varying workloads. Soon it will be September, and it will be time to begin working on the 2006 Budget. The Budget process can be a lengthy, time-consuming project, as each and every line item is carefully considered. This usually takes several months (and is in addition to the other monthly homeowners meeting duties). The Budget must be completed and finished in late November. [There are no meetings, monthly homeowners meeting or otherwise, in December, because people are so busy with family commitments).
In conclusion then, the 2005 Board is asking that homeowners approve the House Rules as written, at the upcoming Special Meeting soon to be announced (watch your mailbox for further details).
